The purpose of these General Terms and Conditions of Sale (hereinafter the “GTC”) is to define the mutual rights and obligations of Hot Form Lab SARL, whose registered office is located at 16 rue du Médecin Lieutenant Bertrand, 06400 Cannes, Alpes-Maritimes, France,  Register under number 101062842, and whose intra-Community VAT number is FR03101062842 (“Hot Form Lab”) and its customers (hereinafter, the “Customer”), in connection with the sale of products via the website www.hotformlab.com (hereinafter, the “Website”) or the mobile application (hereinafter, the “Mobile Application”).

The Terms and Conditions apply to all online sales of individual credits, in the form of introductory offers, packages, or Hot Form Studio subscriptions (the “Credits”) for Lagree classes and similar activities (the “Classes”) sold by Hot form Lab on the Website or via the Mobile App, to the exclusion of all other contractual terms and conditions, including those that may apply to the sale of other products or services offered by Hot form Lab.

The T&Cs constitute the contractual documents binding on the parties, to the exclusion of any other document that is for informational purposes only.

The T&Cs are made available to Customers on the Website, where they can be viewed directly, and may be provided upon simple request to Hot Form Lab.

Any order placed on the Website or via the Mobile App implies full and unconditional acceptance of the T&Cs in effect on the date of the order. Confirmation of the order constitutes unconditional and unreserved acceptance, with Hot Form Lab ensuring the retention and reproduction of the T&Cs in accordance with legal requirements.

Hot Form Lab reserves the right to amend the Terms and Conditions at any time. In the event of an amendment, the applicable Terms and Conditions are those in effect on the date of the order, as confirmed by the email acknowledging receipt of payment; a copy may be provided upon request.

The invalidity of any provision of the Terms and Conditions shall not render the Terms and Conditions or any other provisions invalid.
The occasional non-application of a provision shall not be construed as a waiver.

The use of Credits requires registration on the Website or Mobile App, or on-site with the assistance of Hot Form Lab, through the creation of a customer account (the “Account”) providing access to a personal dashboard for managing reservations and Credits (the “Personal Dashboard”).

Registration is nominative and personal. The Customer guarantees the accuracy, truthfulness, and up-to-date nature of their information and acknowledges that the validated information attests to their identity. Only one Account is permitted per Customer.

The Customer remains responsible for the confidentiality of their login credentials and must immediately notify Hot Form Lab of any unauthorized use. Hot Form Lab may take any appropriate measures in such cases.

The Customer must be of legal age to enter into a contract. Registration is available to individuals aged 16 and older with written parental consent. Orders for children under the age of 16 must be placed by their parents.

Each Credit entitles the holder, subject to availability, to enroll in a class held at the studio operated by Hot Form Lab (the “Class”). Credits are virtual, credited to the Personal Account, and are non-transferable, non-assignable, and non-shareable.

“Introductory” offers may be purchased only once per Customer.

Hot Form Lab may verify the Customer’s identity at the studio reception desk in order to authorize access to the reserved Class.

The services offered, their rates, and their validity periods are presented on the Website or the Mobile App.

Orders are fulfilled subject to availability.

The Customer books Classes via the Website or Mobile App, or in person. Unless otherwise specified, the Customer may cancel up to 12 hours before the start of the Class.

After this deadline, cancellation is not possible and the Credit for the corresponding Class is forfeited.

Absences and late cancellations result in the permanent loss of the Credit.

In the event of a cancellation made within the time limit, the amount of the Class in Credits will be credited to the Customer’s account for future use.

The monthly subscription is for a minimum term of six (6) months and is automatically renewed on a monthly basis.

The Customer may terminate the subscription at the end of each period by providing one (1) month’s notice prior to the end of the period, via email sent to Hot Form Lab, with a subject line explicitly stating “cancellation.”

The Customer may be granted a suspension of the subscription in the event of moving abroad (upon presentation of proof) or medical incapacity (upon presentation of a certificate). Unused subscription months may be carried over. All requests must be sent by email to Hot Form Lab.

In accordance with Articles L. 113-1 et seq. of the French Consumer Code, the sale prices for each Credit are listed on the website in euros, inclusive of all taxes (taking into account the applicable VAT rates and other applicable taxes as of the date of the order).

The total amount owed by the Customer for each Credit is indicated on the order confirmation page.

The price in effect on the date of the order applies.

Hot Form Lab reserves the right to modify its prices at any time, while guaranteeing that the price displayed at the time of the order will apply.

The Customer has a withdrawal period of fourteen (14) days from the date the contract is concluded (placement of the order) to exercise their right of withdrawal for any purchase of Credits on the Site.

To exercise their right of withdrawal, the Customer must send (by mail or email) to Hot Form Lab a clear and unambiguous notice of their intention to exercise their right of withdrawal, specifying the number of the canceled order, as well as their full contact information (name, address, and, if applicable, phone number and email address).

The Customer may not exercise their right of withdrawal with respect to a Credit once the service (Pack, subscription, or individual lesson, as applicable) has been used in whole or in part.

The full price is due at the time of order. Payment is made by credit card online via a secure payment provider or by monthly direct debit for subscriptions only.

The payment methods accepted by Hot Form Lab are listed on the interface provided by the Website at the beginning of the ordering process, and at the latest on the page summarizing the contents of the Customer’s shopping cart.

Subscriptions are automatically charged on the same date each month.

Schedules are available on the Website or the Mobile App. They may be modified without notice and do not entitle the Customer to a refund.

Classes may be canceled at any time by Hot Form Lab without the need to provide a reason for the cancellation, provided that Clients are notified as soon as possible.

Such a cancellation may occur, in particular, if the minimum number of participants is not reached, if the instructor is unable to teach, or if there is a problem with the Hot Form Lab premises. In such cases, the Client may be eligible for a rescheduling or a refund.

By registering for a Class, the Customer further acknowledges that they have read the Hot Form Lab Rules and Regulations set forth in the Appendix to these Terms and Conditions, and agrees to abide by them unconditionally and without reservation. These Rules and Regulations are also available for review at the studio. The Client further undertakes, and more generally, to take all necessary precautions for their health, safety, and hygiene, and to comply at all times and under all circumstances with the instructions issued in this regard by Hot Form Lab, one of its officers or agents, or a service provider designated by it. Hot Form Lab reserves the right to deny access to a Class to any person who violates or has violated the foregoing provisions.

Access to a Class is not permitted once the session has begun. Once the Class has begun, according to the time indicated on the schedule and at the time of booking, access to the Class is permitted up to five (5) minutes after the start of the Class. After this time, Hot Form Lab cannot guarantee access to the Client. The start time of the services may under no circumstances be delayed due to the Client’s tardiness.

It is the Client’s responsibility to verify their fitness to participate in the activities, particularly in cases of medical conditions, rehabilitation, pregnancy, or ongoing treatments. The Client agrees to respect their own limits and follow staff instructions.
The Client certifies that they have liability insurance.

Lockers are provided for the duration of the Class. The Client uses them at their own risk. Osmo Studio disclaims all liability for the loss, theft, or damage of personal belongings, including those left in lockers.

Hot Form Lab shall not be held liable in the event of non-performance or improper performance of the contract due to the Client’s actions, an insurmountable and unforeseeable act by a third party to the contract, or force majeure.

In accordance with Regulation (EU) 2016/679 of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, Hot Form Lab processes personal data for the purpose of selling the products defined in these Terms and Conditions.
Hot Form Lab undertakes to ensure the protection of Customers’ personal data and all personal data obtained in connection with the use of the Website.

The Customer is hereby informed of the following:

Hot Form Lab, whose contact information appears in the header of this document, is the data controller.
Customers’ personal data is processed for the purpose of fulfilling orders placed by the Customer on the Website.
No transfer of Customers’ personal data outside the European Union is planned.
The Customers’ personal data processed is retained for the period necessary to fulfill the contract.
The Customer whose personal data is being processed has the right to request from the data controller access to their personal data, the rectification or erasure of such data, or a restriction of processing concerning the data subject, as well as the right to object to the processing and the right to data portability. This right may be exercised by writing, via mail and providing proof of identity, to Hot Form Lab, 16 rue du Médecin Lieutenant Bertrand, 06400 Cannes, Alpes-Maritimes, France, or to the email address hello@hotformlab.com.
The Customer concerned by the processing of their personal data has the right to file a complaint with the Commission Nationale de l’Informatique et des Libertés.

The personal data requested during the order process is necessary for invoicing (legal obligation); without it, the order cannot be placed.

Hor Form Lab offers nutrition services provided by certified nutritionists and massage services provided by qualified independent practitioners.

The Client must disclose their health status and report any contraindications prior to the session. It is the Client’s responsibility to report, prior to any session, any health issues, ongoing medical treatments, allergies, or specific conditions that could affect the course of the service.

Access to services for minors is subject to prior written authorization from parents or legal guardians.

The Client acknowledges having received all necessary information regarding the nature of the services, their potential risks and contraindications, and gives their informed consent prior to any treatment.

Regarding nutrition services, the Client understands that the advice provided is personalized but cannot replace medical supervision when such supervision is necessary.

Hor Form Lab acts exclusively as an organizer and facilitator of these services and shall not be held liable for any damages resulting from the performance of services by independent practitioners, except in the event of negligence in the organization or provision of the service.

The content of the Website and the Mobile App is the property of Hot Form Lab and its partners and is protected by French and international intellectual property laws.

Any reproduction, in whole or in part, of this content is strictly prohibited and may constitute an infringement of intellectual property rights.

Any complaint regarding an order or these Terms and Conditions must be submitted in writing to Hot Form Lab within the statutory time limits.

Any dispute relating to an order or the T&Cs, their validity, interpretation, performance, termination, consequences, or outcomes, which cannot be resolved amicably between Hot Form Lab and the Customer, shall be submitted to the competent court under the conditions of general law.

The Customer is informed that they may, in any event, resort to conventional mediation, in particular with the Consumer Mediation Commission (in accordance with Article L. 534-7 of the French Consumer Code), or with existing sector-specific mediation bodies, or to any other alternative dispute resolution method (including conciliation) in the event of a dispute.

These Terms and Conditions are governed by French law. In the event of a dispute arising out of or in connection with the performance, termination, or interpretation of these Terms and Conditions, the parties shall endeavor to resolve the dispute amicably.

Subject to applicable public policy provisions, any dispute related to or arising from the validity, performance, interpretation, or formation of these Terms and Conditions shall first be referred to Hot Form Lab to seek an amicable resolution; if no settlement is reached, the matter shall be submitted to the competent courts of Paris.

Access to Classes is restricted to registered members. Proof of identity may be requested at the front desk.
Members must arrive on time for the start of the Class. If you are more than five (5) minutes late, access to the Class may be denied for safety and comfort reasons.
Staff instructions must be followed.
Any unauthorized sales, promotional, solicitation, or sports coaching activities are prohibited.
Smoking or vaping is prohibited in the studio.
Noise disturbances must be kept to a minimum. Any verbal or physical violence is prohibited.

All clients must maintain personal cleanliness, follow hygiene guidelines, and wear appropriate attire for classes. Non-slip socks are required for all classes for health and safety reasons. They are available for purchase at the studio.
Equipment must be left clean after use and cleaned using the products provided.
After use, the towels provided must be placed in the bins provided for this purpose.
Showers are reserved for use after Classes and must not be used for personal hygiene.
Additional health and safety rules may be adopted in accordance with official guidelines.

Lockers must be emptied at the end of each session. Hot Form Lab assumes no liability for loss, theft, or damage.
